  1. INFORMATION ABOUT US: www.planmylondon.com is operated by Plan My London Limited. Our registered office is Rockware Business Centre, Rockware Avenue, Greenford, Middlesex UB6 0AA. We are registered in England and Wales under company number 06942937.
  2. HOW THE CONTRACT IS FORMED BETWEEN US: By completing our questionnaire, you accept our terms and conditions and are making an offer for us to supply the services to you. After completing our online questionnaire, we will acknowledge receipt of your questionnaire by automated email. We will then either send to you email invoice with a link to Pay Pal for the payment of that invoice or, if we need to clarify any aspect of the questionnaire, an adviser will contact you by email to discuss with you specific requirements and confirm a price to you. After receiving clarification, we will send to you email invoice with a link to Pa Pal for the payment of that invoice. You will need to follow the link in our invoice and make payment using Pay Pal. The contract between us will only be formed once we receive payment from Pay Pal and confirm by email acceptance of payment to you.
  3. OUR SERVICE: We warrant to you that:
    a. Out itinerary will be of satisfactory quality on the date on which it is sent to you. In this regard, we will use good skills in putting together an itinerary and produce it using standard fonts and layouts (and you can view a sample on our website before entering into a contract with us). We cannot, however, be responsible for any goods or services that you may purchase or use when following our itinerary. For example, the quality of food purchased at a suggested venue, the closure of a particular venue, the closure of any part of the transport network, availability of tickets, the quality of entertainment and so on.
    b. We will prepare an itinerary for you in accordance with your reasonable instructions as set out in your completed questionnaire and any other specific requirements that you bring to our attention. We will, unless you draw to our attention specific medical conditions, presume that you are in good health. If you draw our attention to any medical conditions, we will take these into account when preparing an itinerary.
    c. To the extent that it is reasonable, ensure that you are satisfied with the itinerary. You will therefore need to bring to our attention as quickly as possible any aspect of the itinerary that you are not reasonably satisfied with and we will explore with you available options.
    d. The itinerary will be fit for the purpose for which it is prepared. In this regard, the purpose of the itinerary is to provide you with a list of places to visit in an order which enables you to make the most of your day. Your day, and the ability to carry out all the activities in an itinerary within the timescales set out, will depend on a number of factors: you may decide to spend more time at some places and less time on others; you may wish to deviate from the itinerary; members of your party may have conflicting views and slow your ability to visit all attractions; there may be public works or delays in transportation; there may be other factors that affect your ability to follow the itinerary in the exact way in which it has been set out or that may enhance or detract from your enjoyment of the day.
  4. WEBSITE LINKS: We may provide links on our site, in our emails and in our itineraries to websites of other companies. If you decide to purchase a product, or order a service, from such a website the resulting contract will be between you and the operator of that website. You should therefore review their terms and conditions carefully, and these should be advised to you by the operators of those sites. We are simply providing the links to you to make information more easily accessible and are not a party to any transaction agreed between you and the operator of such a website.
  5. DELIVERY: We will send to you by email the itinerary within 7 days (although we will endeavour to do this in 5 days) of us confirming to you that payment has been accepted. Please send us an email to info@planmylondon.com if you have not received the itinerary in this timescale.
  6. PRICE AND PAYMENT: The price of our service will be the price quoted on our website from time to time. The price quoted on our website is based on an itinerary for one questionnaire being completed for up to four people and delivery of an itinerary within 7 days of the contract being formed. A supplement will be payable if the itinerary is to be used by more than four people or an itinerary is required more quickly than the standard delivery times. If more than one questionnaire is submitted, then each questionnaire will be charged at the full price for that itinerary. If you require a visit from an adviser at your hotel or a guided tour for a day or part of a day then please let us know and we will make appropriate arrangements after discussing (by telephone or email) your requirements with you and agreeing dates, times, price and payment.
  7. REFUNDS: We will normally start working on your itinerary after the contract is formed, unless you ask us to wait for a period of 7 days before starting to work on your itinerary. If you ask us to wait, you will be entitled to a refund if you cancel your contract within 7 days of the contract being formed. If you don’t ask us to wait, you will not have the right to cancel the contract. Any refund made by us will be made using the same method of payment with which you originally paid.
  8. OUR LIABILITY:
    If we fail to comply with any of the provisions of this contract:
    a. We will only be responsible for losses suffered by you which were a foreseeable consequence of our failure to comply with the relevant provisions of this contract;
    b. We will not be responsible for any:
    i. Loss of income;
    ii. Loss of anticipated savings;
    iii. waste of time;
    iv. loss of enjoyment;
    c. We are not, in this paragraph 8, limiting in any way our liability for:
    i. Death or injury caused by our negligence;
    ii. Fraud or fraudulent misrepresentation;
    iii. Any breach of any obligations implied by relevant statutes and law;
    d. Our liability will be limited to 5 times the value of any price paid by you to us in respect of the itinerary in which we failed to comply with the terms of this contract and where the loses were foreseeable and could have been contemplated by you and us at the time at which we accepted your order.
  9. INTELLECTUAL PROPERTY: We are the owner or licensee of all intellectual property rights on our site, and in the material published on it. The content on our site is protected by relevant laws. All rights are reserved. In particular, we own the intellectual property rights in itineraries that we provide to you and you must not use any itineraries that we provide to you for commercial purposes without obtaining a licence in writing to do so from us. The itineraries are provided to you and the people with whom you are travelling and you are not entitled to make copies of the itinerary or to provide the itinerary to others who have not paid for the benefit of the itinerary.
  10. NOTICES: A notice given by you to us must be given to Plan My London Limited at info@planmylondon.com. We may give notice to you at the email address you provide to us. Notice will be deemed received and properly served 24 hours after an email is sent. In proving the service of any notice, it will be sufficient to prove that such e-mail was sent to the specified email address of the addressee. Communications by email are agreed to be accepted as communications in writing.
  11. EVENTS OUTSIDE OUR CONTROL: We will not be liable or responsible for any failure to perform, or delay in performance, that is caused by circumstances beyond our reasonable control including, without limitation: failure of utilities, communication or transport networks; acts of God; civil commotions; accidents; health conditions; failure by third party suppliers of goods or services; ill health; death; civil commotion; any act or omission by a government or competent authority; or industrial disputes.
  12. THIRD PARTIES: A person who is not a party to this contract will not have any rights under or in connection with this contract under the Contracts (Rights of Third Parties) Act 1999.
  13. WAIVER: If we fail, at any time whilst this contract is in force, to insist that you perform any of your obligations under this contract, of if we do not exercise any of our rights or remedies under this contract, that will not mean that we have waived such rights or remedies and will not mean that you do not have to comply with those obligations. If we waive a default by you, that will not mean that we will automatically waive any subsequent default by you. No waiver by us of any of the provisions of this contract shall be effective unless we expressly say that it is a waiver and we tell you so in writing.
  14. SEVERABILITY: If any court or competent authority decides that any of the provisions in this contract are invalid, unlawful or unenforceable to any extent, that provision will to that extent only, be severed from the remaining terms which will continue to be valid to the fullest extent permitted by law.
  15. ENTIRE AGREEEMENT: We intend to rely on these terms and conditions and any document expressly referred to in them in relation to the subject matter of this contract. Please make sure that you ask for any variations from these terms and conditions to be confirmed in writing.
  16. LAW AND JURISDICTION: This contract and the supply by us to you of any products or services will be governed by English law. Any dispute or claim arising in connection with the supply by us to you of any products or services shall be subject to the non-exclusive jurisdiction of the English courts.
